Assumption of All Risks

acknowledge that I have voluntarily applied to participate on the tour designated on this Guest Registration (or a tour which I may subsequently transfer to). I am voluntarily participating on the tour with knowledge that travel to the foreign countries and/or remote areas visited by this tour involves numerous risks and dangers including but not limited to: the forces of nature; civil unrest; terrorism; roads, trails, hotels, vehicles, boats or other means of conveyance which are not operated or maintained at standards common in the United States; high altitude; accident or illness without access to means of rapid evacuation or availability of medical supplies; the adequacy of medical attention once provided; physical exertion for which I am not prepared; consumption of alcoholic beverages; or negligence (but not willful or fraudulent conduct) on the part of Inka's Empire Tours (hereafter referred to as "Inka's"), or others. I acknowledge that the enjoyment and excitement of a tour is derived in part from the inherent risks incurred by travel and activity beyond the accepted safety of life at home or work and that these inherent risks contribute to such enjoyment and excitement, being a reason for my voluntary participation. I hereby agree to be responsible for my own welfare, and accept any and all risks of delay, unanticipated events, illness, injury, emotional trauma, or death and verify this statement by placing my initials here: ____________ .
Release of Liability
These paragraphs define our responsibility with respect to all our tours. Please read them carefully. Payment of your deposit represents your acceptance of the following terms and conditions:
I acknowledge that the cost of all Inka's tours is based upon tour participants executing this Release of Liability and Assumption of All Risks. Therefore, as lawful consideration for being permitted to participate on such tour(s), I hereby release and discharge Inka's and its agents and employees from and against any and all liability arising from my participation in the tour (other than willful or fraudulent conduct on the part of Inka's). I agree that this release shall be legally binding upon myself, all minors under the age of 21 traveling with me, my heirs, successors, assigns, and legal representatives; it being my intention to fully assume the risk of travel as provided in the section above entitled Assumption of All Risks and to release Inka's from any and all liabilities to the maximum extent permitted by law, except as expressly excluded above.
Inka's gives notice that services provided in connection with its itineraries, including transportation, hotel accommodations, restaurants, and other services, are purchased from various independent suppliers who are not affiliated with Inka's in any way. Although it endeavors to choose the best suppliers available, Inka's has no right to control their operations and therefore makes these travel arrangements upon the express condition that Inka's, and its own agents and employees, shall not be liable for any delay, mishap, inconvenience, expense, irregularity, bodily injury or death to person, or damage to property occasioned through the conduct or default of any company or individual engaged in providing these services. Each of these passenger conveyance companies, tour companies, hotels, restaurants, and providers of other services, is subject to the laws of the state or country where the service is provided.
Inka's shall not be liable for: (a) expenses such as ticket change fees, new tickets, alternative transportation or additional hotel nights and meals not specified in the individual tour itineraries that may be required either en route, prior to, or following a trip, when caused by guest's travel arrangements, by airline scheduling or airline schedule changes, canceled flights, missed flight connections, or by other factors not under control of Inka's; (b) expenses incurred in recovering luggage lost by airlines, belongings left behind on a trip, or in shipping purchases or other goods home from abroad; (c) bodily injury or property damage for any reason, including but not limited to acts of God, weather, quarantines, strikes, civil disturbance, theft, default, detention, annoyance, changes in government regulations, terrorism, war, or failure of conveyance to arrive or depart as scheduled, over which Inka's has no control. Your travel insurance will reimburse you for covered hazards.
Inka's reserves the right to make changes in the itinerary whenever we deem it necessary for the comfort, convenience, or safety of the tour participants and to substitute equivalent hotels without notice. Inka's reserves the right to decline to accept -- or to restrain from further participation -- any person it judges to be incapable of meeting the rigors and requirements of participating in the activities, or any person whose actions or deportment impede tour operation or the rights, welfare, or enjoyment of other tour members. A refund based on the cost of unused land services is the limit of Inka's responsibility in such a case.
I understand that all guest registrations are subject to acceptance by Inka's and upon acceptance will be deemed to have been entered into and to be performed in New York, New York. In the unlikely event a legal dispute should arise involving any subject matter whatsoever, I agree that the following conditions will apply: (a) the dispute shall be settled by binding arbitration through the American Arbitration Association in New York, New York; (b) the dispute shall be governed by New York law; and (c) the maximum amount of recovery to which I will be entitled under any and all circumstances will be the land cost of my tour with Inka's. I agree that if any portion of this agreement is found to be void or unenforceable, the remaining portions shall remain in full force and effect.
Travel insurance
Inka's Empire Tour includes travel insurance for guests through the age of 59 years (over that age, there is a supplementary fee). U.S. residents are covered by AIG Travel Guard's ProtectAssist policy. Canadian residents receive similar insurance from AIG. International residents are advised to purchase coverage in their home country and will receive a corresponding reduction in the tour price. For questions about the travel insurance and how it applies to your particular circumstances, please call AIG Travel Guard (1-800-826-4919) or the company you have selected in your own country. You may wish to consider an Air Ticket Protection Plan for your international flights. Inka's can include it for an additional cost of 5% of the ticket price.
Cancellations, postponements & refunds
Cancellation and postponement dates are computed as of the date of our receipt of your written notice. The cost of travel insurance and intra-tour air fares is non-refundable. The remaining tour price is refundable as follows:
At least two months' written notice prior to tour commencement, the refund is 50%*
Less than two months' written notice prior to tour commencement, there is no refund.*
*Please note that any tour including a Galapagos cruise or a stay in an Explora hotel requires one additional month of notice.
Your travel insurance will reimburse you for losses due to covered reasons of cancellation or postponement. You must file a claim and provide required documentation. No partial refunds will be given for unused tour services. Inka's reserves the right to cancel any tour prior to departure for any reason whatsoever. Written notice shall be given to the guest as soon as possible, and the refund of all payments received shall release Inka's from any further liability. To date, Inka's has never cancelled a tour. In all cases of force majeure, we have offered our guests an alternative itinerary, which they have accepted. Any refund due shall be paid within one month of written notice.
Trade names
Inka's Empire Corporation, a New York corporation, is registered with the State of New York to do business as Inka's Empire Tours.
Guest's responsibility
Guests have the responsibility to select a tour appropriate to their abilities and interests. We are ready to discuss any tour with you as well as provide you with names of past participants who can describe their experience with us to you. Guests are held responsible for being in sufficient good health to undertake the tour, for preparing for it by studying the Tour Itinerary, Opulent Itineraries, Travel Advice, Avoiding Altitude Sickness and other pre-departure information sent by Inka's, and for bringing the appropriate clothing and equipment as advised therein.
Knowing & voluntary execution
I approve the final itinerary, dated ____________ , schedule of services and price of $ ____________ per person submitted to me separately by Inka's. I have carefully read and fully understand the contents and legal ramifications of this agreement. I understand this is a legally binding and enforceable contract and sign it of my own free will.
